General Terms and Conditions of Sale
THE PARTY APP LTD


Definitions

  • The Customer - refers to any person wishing to place an order on the partyapp.mu website or who has already purchased a ticket at the entrance of an event managed by Partyapp.
  • The Organizer or Event Producer(s) - refers to the individual, association, or company that uses the partyapp.mu platforms to sell their tickets or products. Partyapp is a platform for selling electronic tickets made available to organizers.

The organizer communicates to the Partyapp team the responsible person(s): the person(s) holding the confidential access codes and who connects to the Dashboard, to the professional mobile application Partyapp access or the drive file / Partyapp dashboard site.

The Dashboardis the professional Partyapp space that allows the organizer to manage their event online.

Partyapp access is the professional Partyapp mobile application that allows the organizer to control their tickets during an event.

The website partyapp.mu is the public platform intended for the public to discover and purchase tickets for events.

How Partyapp Works

Partyapp is a ticketing solution that allows organizers to sell their tickets to customers with a unique ticketing experience.

Partyapp is a sales intermediary. Partyapp's responsibility is limited to the technical execution of ticket sales. The responsibility for sales, what they entitle, their compliance with laws and regulations, and their consequences remain the responsibility of the organizer(s).


1. Use of Partyapp by Customers

1.1 - Purchase and Receipt of the Ticket

A customer can purchase Partyapp tickets on a Partyapp domain or subdomain (partyapp.mu, Partyapp.re, Partyapp.app, etc.). Contrary to current regulations, all purchases are firm and final and do not give rise to a withdrawal period. Partyapp maintains a strict no refund policy.

In case of event cancellation, see section 2.5.
In case of event postponement, see section 2.5.

The customer must choose their ticket and quantities, provide the necessary information for the order, and choose their payment method. Then, the customer must enter their banking information (credit card, mobile banking services, or other scanner for payment) before passing through their bank's secure 3D control to make a secure payment. After confirmation of a successful payment, the customer will receive their ticket by email and can download it directly in QR code format & the ticket in question will also be generated in their wallet section.

In case of a group order, the ticket owner is the initial buyer and can transfer their tickets to persons of their choice. Depending on the prior conditions imposed by the organizer, Partyapp tickets are personal but not named.

1.2 Ticket Ownership

Duplicating a ticket or transferring it to an illegitimate person is strictly prohibited. Accordingly, the first person to present the ticket at the access control will be recognized as the legitimate owner of the ticket.

1.3 Resale of Ticket(s)

The resale of one or more tickets is possible by the buyer directly. It is the responsibility of the latter, however, to inform the Partyapp team of the change.

When the integrated resale function is available on the Partyapp site, the customer is informed of the fee applied to the resale desired by the holder. The holder can accept the fee and proceed with the resale or refuse and cancel the sale.

1.4 Fraud

Illegal resale, duplication, communication of false information, use of fraudulent payment methods are strictly prohibited and may result in the deletion of the ticket.

In case of fraud, or any behavior that may directly or indirectly incite hatred or violence, a customer may have their ticket permanently deleted and be denied access to events of the organizer(s).

1.4 Access Control

Each ticket entitles to a unique event whose validity times are mentioned on the ticket and on the Partyapp event page where the tickets were purchased.

Entry to an event is subject to ticket control, which grants access to a single entry, unless otherwise indicated in the event.

  • A ticket containing one entry:
    This ticket can be presented only once at control, and the first person presenting the ticket will be presumed to be the legitimate owner of the ticket.
  • A ticket containing multiple entries
    This ticket can be presented multiple times at control but will no longer be valid once the number of entries contained in the ticket has been validated.

Purchasing a ticket for an event implies adherence to its own regulations. An identity document may be requested during access control, so it is mandatory to have it with you.

1.6 Personal Data

Collected by Partyapp. The personal data that the customer provides on the platform allows the completion of the transaction and payment, transmitting information related to the event, enabling the organizer to better understand their audience, particularly their artistic preferences and their preferences and frequency of outings.

This information also allows for the transmission of ordered tickets and for organizers to send practical information related to the holding of the event and future ones.

Banking details provided at the time of ticket purchase are not saved on Partyapp platforms. The details pass through a service provider, MIPSIT Digital Ltd, which facilitates technical integrations between Partyapp and payment method providers. The provided banking details are secured and encrypted by MIPS, making said data inaccessible to Partyapp and the organizer.

Furthermore, depending on the organizer's prior conditions for the event, additional data is collected (but not limited to) for the proper functioning of the service:

  • Name
  • First name
  • Phone number
  • Address
  • Age
  • Gender
  • Geolocation at the time of placing an order
  • Any consumption preferences expressed on the Partyapp site

The customer is automatically added to Partyapp's email list. Therefore, the customer will receive our special offers, event announcements, and important information related to all events. However, the customer can unsubscribe at any time.

1.7 Customer Billing

Partyapp may charge the customer an additional fee, which may be added to the ticket price or included in the price, for certain events or certain types of rates.


2. Use of Partyapp by Event Organizers

2.1 Primacy of the Contract

These general terms and conditions of sale are expressly adopted by any event organizer who sells tickets on Partyapp. However, if the provisions of a contract signed between an event organizer and a Partyapp representative differ from those of these general terms and conditions of sale, the contract shall take precedence.

2.2 Functioning of the Dashboard

The Dashboard is the professional Partyapp space that allows the organizer to manage their event online. As such, the dashboard allows the organizer to monitor ticket sales, access customer information, view received orders, invitations, and the revenue of their event.

2.3 Billing

Partyapp charges its services to event organizers and to the public (if imposed) as follows: a ticketing fee agreed with the event organizer, deducted from each ticket purchase at the time of the transaction. The fee consists of a variable and fixed part (listing fees), plus, if necessary, a fixed minimum per transaction.

  • Variable Part
    The variable part (% on each transaction) is determined by the offer the organizer subscribes to.
  • Fixed Part
    The fixed part represents the listing fees (fees to use the Partyapp platform), the fees for ads (announcements) to be displayed on the site & other services offered by Partyapp.
  • Fixed minimum per transaction
    Partyapp reserves the right to impose a fixed minimum per transaction depending on the event model to the organizer.

    All billing information is accessible from the organizer's Dashboard and is sent to the responsible person(s) by email at the end of each event.

    These data are conclusive in any case. As well as all sales performance and visibility information of the Partyapp platform.

2.4 Ownership & Responsibility of the Admin Account

The individual and professional responsibility of the account accessing the Dashboard lies with the account holder. The holder bears all responsibility from the moment they access the Dashboard with the link or the confidential credentials provided by Partyapp by email or other communication support.

In case of conflict over the identity of the responsible person, the person who has provided their identity document and personal information will be considered the legal responsible for the Dashboard.

2.5 Responsibility for the Event

The event is the sole responsibility of the organizer; notably, compliance with current regulations and laws, obtaining permits, legality of the event, customer safety during the event, the reception policy (if managed outside of the Partyapp team) and the refund procedure in case of cancellation or postponement.

As a sales intermediary, Partyapp could not be held responsible for any of these situations.

In case of event cancellation, the customer must be refunded 100% and the organizer must settle the invoice due to Partyapp (listing + ticketing fees + others if incurred).

In case of postponement, the customer(s) will be given the choice to keep their ticket(s) for the next date, for another event, or to be refunded.

2.6 Illegal or Dangerous Event

In case of an event considered illegal, dangerous, directly or indirectly inciting hatred or violence, Partyapp reserves the right to stop sales of this event without obligation & proceed to refund ticket holders.

2.7 Release of Liability

The organizer declares having read the conditions of the following release of liability. They declare and guarantee to Partyapp that this release of liability, once accepted, will constitute valid and binding legal obligations for them.

2.8 Powers

The signatory, organizer, or representative of the organizer, declares and guarantees to Partyapp that they have all the necessary rights, powers, and corporate authorizations to sign this release of liability and fulfill the resulting obligations.

2.9 Definitions

The following terms (singular or plural) shall have the meaning defined below, unless otherwise specified or the context does not allow such meaning:

  • Customer - refers to any person placing an order on the Partyapp site or who has already purchased a ticket for an event managed by Partyapp.
  • Organizer - refers to the individual, association, or company that uses the Partyapp service platform to sell their tickets or products in connection with their event.
  • Event - refers to any festival, concert, or stage, musical, sports, corporate, or other performance managed by the organizer via Partyapp.
  • Information - refers to any information or data that the customer or the organizer communicates to Partyapp in connection with the organization of an event.

2.10 Responsibility
2.10.1 Event Organization

The organizer declares and guarantees to Partyapp that they have all the necessary rights and authorizations to organize the event for which Partyapp's participation is requested under its service platform offer.

The organizer declares and guarantees to Partyapp that they have taken all necessary measures to ensure that the event they organize complies with all applicable laws in force in the territory, ordinances, regulations, and administrative obligations.

The organizer guarantees to Partyapp to implement COVID-19 prevention measures if applicable.

The event falls under the sole responsibility of the organizer as stipulated in section 2.5.

The organizer releases Partyapp from any liability that may result from organizing an event, and notably from any liability arising from the service providers involved in organizing the event.

The organizer agrees to inform Partyapp as soon as possible of any request for information from an administrative, police, or judicial authority concerning the organization of an event.

2.10.2 Partyapp's Contractual Documentation

The organizer acknowledges having read the general terms and conditions of sale, the general terms of use, and the privacy policy of Partyapp, as available and periodically modified on the Partyapp website (https://Partyapp).

2.10.3 Communicated Information

The organizer declares and guarantees to e-tickets that all the information they provide (about themselves or their customers) to Partyapp is complete and accurate and does not violate or infringe any right to privacy, confidentiality obligation, or any other personal or moral right of any third party.


3. Data Protection related to the Data Protection Office

Partyapp is registered as a data controller with the data protection office and collects data legally according to the Data Protection Act 2004.

3.1 Definitions

In this section, the terms: 'we', 'our', and 'us' refer to Partyapp (E-TIX.IO LTD). 'You', 'your', and 'yours' refer to any natural person of legal age or capable of contracting using the Partyapp site or accessing it.

In this policy, the terms 'we', 'our', and 'us' refer to E-TIX.IO LTD. 'You', 'your', and 'yours' refer to any natural person of legal age or capable of contracting using the Site or accessing it.

3.2 Purpose

This section describes the methods we use to collect, save, process, and use your personal data, as the data controller.

By providing us with such information and using Partyapp, you consent to us collecting, saving, processing, and using your personal data according to current legislation and the provisions of this section, which is an integral part of the general terms and conditions of sale.

What data do we collect?

We collect your personal data in two ways:

  • The information you enter on Partyapp - to access our services, particularly to place an order via Partyapp or register, you must create an account on the Site and provide us with a certain amount of personal information, namely: name, first name, email address, phone number, gender, etc.
  • The information we collect automatically when you use our Site - Regardless of your status, User or Customer, we collect and process various information regarding your use of the Site, such as your browsing preferences, statistics regarding the most visited pages on our Site, etc.

Partyapp and its subdomains may contain links to other sites, such as Facebook, to which this section does not apply. Please note that we cannot be held responsible for the activity of these sites or their content. We encourage you to read the applicable privacy policy before visiting a new site.

For what purposes and on what legal basis do we collect your data?

All collected information is processed for managing the functionalities of Partyapp and primarily for managing ticket orders and adapting the content of our platforms based on your preferences. The collected data may also be used for statistical studies, marketing, or analysis purposes.

Finally, the collected data may be processed by Partyapp and/or by its event organizer partners. The processing of Customers' data is based on the execution of a sales contract.

The processing of Users' data is based on the consent you provide for the use of the Facebook pixel (cookie), via our usage request banner on Partyapp.

The processing may also be based on your consent when such consent is required (for example, for using your data for electronic commercial prospecting purposes).

With whom do we share your data?

The recipients of the collected data are:

  • Partyapp (us),
  • Organizers (our business partners),
  • our subcontractors (such as the hosting provider).

We ensure that data recipients provide serious guarantees of data security and confidentiality.

Where is your data stored?

Your data is stored on servers in the USA, Europe, Africa, and the Middle East.

How long is your data kept?

Customers' data is kept for as long as necessary to manage their processing and to fulfill the aforementioned purposes.

Regarding our newsletter, we collect your email address for this purpose, subject to your unsubscription, which can occur at any time. Data collected through cookies is kept for a maximum of 13 months.

What are your rights?

Under the Data Protection Act and GDPR, you have the right, regarding the processing of your personal data, to access, oppose, rectify, and erase your data.

Furthermore, you have the right to provide Partyapp with instructions that define how you want your personal data to be processed after your death (e.g., indicating if you want it to be kept, erased, or communicated to a designated third party).

Finally, you can, if applicable, request the erasure of personal data that was collected when you were a minor.

Moreover, you can also exercise (in addition to the aforementioned rights) your right to restrict processing and your right to data portability, as provided by GDPR.

At any time, you have the right to withdraw your consent to the processing of your personal data (for any processing based on your consent).

You can assert your right not to be subject to a decision based solely on automated processing (such as profiling, for example) that produces legal effects concerning you or significantly affects you.

3.3 Updating the Section

We reserve the right to amend this section to comply with the advancement of our technology, best professional practices in the matter, or changes in legislation. If these changes are substantial, we will inform you and, if required by law, request your consent again.
